Employers must ensure their staff are taught how to do their job properly and safely to avoid accidents or personal injury at work. This is a wide-ranging duty and covers systems and methods of work, use of machinery and other work equipment, and use of personal protective equipment.
Perhaps not surprisingly, given the broad spectrum of areas covered by this duty and its importance to the health and safety of individuals, there are a large number of regulations detailing the obligations imposed on employers in respect of their employees, including;
· The Manual Handling Operations Regulations 1992,
· The Personal Protective Equipment at Work Regulations 1992, and
· The Provision And Use of Work Equipment Regulations 1992
There are many others besides these.
Employers must make a proper assessment of a worker’s abilities and knowledge for themselves, irrespective of whether the worker has undertaken similar work (or even the same work) in a previous job. They must also ensure that training is repeated regularly and updated if necessary. New matters, such as new work equipment or working methods, are to be covered in initial and revised training.
The absence of training is often raised as contributing factor in work place personal injury compensation claims, and we will ensure that copies of the correct documentation and the necessary evidence is sought in respect of your training. This will give your case for personal injury compensation the greatest chance of succeeding.
