Unfortunately every year many people are victims of accidents abroad. These can range from simple trips to more major disasters. If you have had the misfortune to be injured abroad, you may be able to claim compensation not only for your injury but also, where appropriate, for the element of your holiday that was ruined.
On your return home you should seek specialist legal advice.
What to do when abroad
Ensure your accident is reported to the tour operator’s representative and, if your accident occurred within the hotel/hotel grounds, to the hotel management.
Make sure you or a member of your party completes a customer complaint form/accident report form, gets the representative to sign it and that you are provided with a copy to keep.
If you cannot obtain a customer complaint form/accident report form, write your complaint out in duplicate, get someone outside your party to witness and sign it and then give a copy to your representative keeping one for yourself. If, due to your injuries, you are unable to do this then ask a member of your party to do this for you.
Ensure that your accident is recorded in the hotel’s accident/incident book.
Retain copies of any medical receipts/notes, receipts for taxis and any other out of pocket expenses incurred as a result of your accident.
Take the names, addresses and telephone numbers of any witnesses to your accident.
Take photographs/video footage of the location of your accident.
Draw a plan of the accident scene.
