It is quite normal for anyone wishing to make a compensation claim to be concerned about how much the process is likely to cost, and this is likely to affect their decision on whether or not to pursue such a claim. With the lack of availability of Legal Aid the concern about funding for fees and costs is understandable.
Farnworth Rose operates Conditional Fee Agreements (CFA’s), which were developed to replace the Legal Aid system. These are more commonly known as No Win No Fee Agreements.
What is No Win No Fee?
When you initially consult a personal injury solicitor following an injury that you have sustained which was not your fault, it is likely that you will enter into a No Win No Fee Agreement with your personal injury solicitor. The No Win No Fee Agreement is available to anyone in the UK regardless of their financial position.
By entering into the No Win No Fee Agreement you will not be responsible for payment of any legal fees or other payments required in bringing about a personal injury claim. This is the case whether or not your personal injury claim is successful.
After the Event Insurance
It is quite possible that when you sign the No Win No Fee Agreement your personal injury solicitor may suggest that you enter into After the Event (ATE) Insurance, which is an insurance policy that is taken out to protect you against any fees or costs that may be incurred by you in the pursuance of your personal injury claim. It will not be necessary for you to pay for the cost of this policy. The cost of the policy will be recovered from the party who is negligent on the settlement of the claim.
What will it cost?
It will cost you absolutely nothing regardless of whether you win or lose your personal injury claim. This means that if your personal injury claim is successful you will receive 100% of the compensation that is recovered.
