Even the best-made holiday preparations can go wrong. Preparing for a holiday can be stressful, and the last thing you need is a holiday accident or illness abroad, which can ruin your annual trip. You should always have a ´PLAN B´ to prepare for any eventuality on holiday – even the most unexpected things can, and do happen.
If you encounter a holiday accident or holiday illness abroad, for which you may be entitled to compensation, always remember:
1. Stay calm and in control – and make an immediate report/complaint to the holiday representative at the hotel/resort. Always give the tour operator the chance to make amends.
2. Always fill out the customer services report form, and keep a copy of any paperwork you sign.
3. If you are told that no customer service report forms are available, then make your own. Make 2 copies – one for you and one for the holiday rep, and where possible, get someone to witness the forms being signed.
4. Never accept compensation on the spot. You will only find out how much compensation you are entitled to by contacting a personal injury solicitor in the UK who specialises in holiday illness and accident compensation claims. Do not sign any document which could affect your rights before contacting a personal injury solicitor, and never sign documents that are written in another language.
5. Write down the names, addresses and telephone numbers of other holidaymakers who may have the same complaint as you. Norovirus and food poisoning, for example usually affects more than one group of people.
6. Wherever possible, take photographs and video evidence of anything relating to the claim, which will help when you contact a personal injury solicitor on your return to the UK.
7. On returning home - complain within 28 days in writing, keep a copy and send it to the tour operator by registered mail or recorded delivery.
8. If you are making a complaint to a tour operator, and they are members of ABTA, they must abide by the ABTA Code of Conduct and they must acknowledge your letter of complaint within 14 days and reply to you within 28 days.
9. If the tour operator fails to meet the ABTA Code of Conduct, then you can write to ABTA and complain. If ABTA considers it appropriate, they can investigate the matter and will possibly fine their member for breaching the Code of Conduct.
10. Never accept a cheque or payout from the tour operator until you have spoken to a personal injury solicitor in the UK. Accepting any amount could prevent you from taking legal action in the future. Always take expert legal advice from a personal injury solicitor who specialises in holiday illness and accident compensation claims.
